A Florida couple sued the CEO of Titanic tourism company OceanGate Expeditions and accusing him of misleading them about their trip to visit the wreck and refusing to refund their $210,258 when they complained.
Marc and Sharon Hagle, who made their fortune in commercial real estate, are well known for their philanthropy and their adventurous spirit. In March 2022, they were on the fourth Blue Origin passenger space flight and became the first married couple to become space tourists.
In 2016, while on a trip to the South Pole, they decided their next adventure would be underwater. In 2017 they were announced as among the first customers for OceanGate, which was founded in 2009 by Seattle-born aviator and businessman Stockton Rush, now 61.
But they never got to take their trip, and in February this year sued Rush, accusing him of selling the adventure knowing it was not on schedule, and refusing to refund their cash.
OceanGate's submersible, the Titan, is currently missing with five people on board after it lost communication during a dive to the Titanic's wreckage, which is around 12,500ft below the Atlantic.
A frantic search and rescue operation is underway to locate and recover the vessel before its 96-hour oxygen supply runs out.

Seattle-born Rush, 61, founded OceanGate Expeditions in 2009 - after trying, and failing, to buy explorer and businessman Steve Fossett's submersible, after the adventurer died in a 2007 plane crash.
As a young man, Rush was more interested in space than deep seas: At 19, he became the youngest jet transport-rated pilot in the world, qualifying with the United Airlines Jet Training Institute.
For the next three years he flew for Saudi Arabian Airlines on his summer holidays from his aerospace engineering course at Princeton.
From 1984 he worked with the US Air Force on F-15s and anti-satellite missile programs, with the aim of eventually taking part in the space program.
Rush obtained an MBA from Berkeley and went on to work for multiple companies, specializing in sonar, subsea technology and radars.

He built a Glasair III experimental aircraft which he flew regularly, and his own Kittredge K-350 two-man submersible.
Rush always intended to take tourists to the Titanic: in 2017, he said he planned to then branch out to excursions to hydrothermal vents or deep-sea canyons, and underwater battlefield tours.
He then hoped to work with oil and gas exploration.
In 2018, the Manned Underwater Vehicles committee of the Marine Technology Society, a 60-year-old trade group, warned that the 'current 'experimental' approach' of the company could result in problems 'from minor to catastrophic.'
The company also fired David Lochridge, who was Director of Marine operations for the Titan project, after disagreeing with his demand for more rigorous safety checks on the submersible, including 'testing to prove its integrity'.
Additionally, the company opted against having the craft 'classed', an industry-wide practice whereby independent inspectors ensure vessels meet accepted technical standards.

Rush is also understood to be on board the vessel, which vanished Sunday, along with French Navy veteran PH Nargeolet.
The Hagles claim that Rush, a Princeton-educated engineer and pilot with a MBA from Berkeley, traveled to their home in Winter Park, a suburb of Orlando, Florida, to convince them to buy in to his company.
The submersible he intended to use was named Cyclops 2 at the time - it has since been renamed Titan.
'During their September 27, 2017 meeting, Rush made several false statements of material fact to Plaintiffs, including, without limitation: (a) regarding the status of development and testing of Cyclops 2 as of that date, (b) that Cyclops 2 would be ready to dive on the Titanic by June of 2018,' the suit, obtained by The Daily Beast, reads.

'(c) if plaintiffs had any questions or concerns as to the integrity of Cyclops 2 and/or the timing of the expedition if it were to be delayed, they could request, and would receive, a full refund of all monies paid with no questions asked, and (d) plaintiffs' deposits were, and any future payments by plaintiffs would be, held in a dedicated client escrow account separate from his or OceanGate's funds.'
They claim the trip was postponed by a year three separate times, due to testing requirements and unspecified 'equipment failure.'
They said their money was not - as had been promised - kept in a separate account, where they could recover it.
The company allegedly told the Hagles they could join a 2021 mission to the Titanic's sunken hull, but not get a refund.
They argued that Rush violated state fraud and unfair and deceptive practices statutes.
The Hagles are seeking the return of their money, as well as attorneys fees and other reimbursement for their pains. it's unclear the status of the lawsuit
'Given the willful, wanton, and egregious nature of Rush's conduct, plaintiffs reserve the right to seek to have punitive damages awarded herein,' the complaint states.
Marc Hagle, asked about the suit, told The Daily Beast: 'My thoughts go out to the owners of Oceangate, the people that are on the submersible, both the crew and the guests.
'And we're hoping for a miracle and that everybody comes home safely.
'I think the pleadings speak for themselves.'
OceanGate, asked about the case, said: 'Our entire focus is on the wellbeing of the crew and every step possible is being taken to bring the five crew members back safely.'

In 2019, the firm added that seeking classification for Titan would not 'ensure that operators adhere to proper operating procedures and decision-making processes – two areas that are much more important for mitigating risks at sea'.

They added: 'These organizations have rules and safety standards for the design and construction of systems ranging from submersible vehicles to super tankers and oil platforms.
'The main classification organizations for submersibles include the American Bureau of Shipping (ABS), Det Nortke Veritas (DNV) and Lloyds Registry (LR) among others.
'The submarine industry has a safety record of fifty years without incident.
'This is due to the engineering discipline and professional approach exercised by members of the industry, and the collective observation of (and adherence to) a variety of safety standards.'

The Boston Coast Guard is now looking for the missing vessel. At 12,500ft underwater, there are few vessels able to dive deep enough to find it.
It comes after DailyMail.com revealed that OceanGate refused to put their submersible through an independent inspection process and fired a director in 2018 after he asked for more rigorous safety tests.
Bosses fired David Lochridge, who was Director of Marine operations for the Titan project, after disagreeing with his demand for more rigorous safety checks on the submersible, including 'testing to prove its integrity'.

The company also opted against having the craft 'classed', an industry-wide practice whereby independent inspectors ensure vessels meet accepted technical standards.
OceanGate, which charges up to $250,000 for a seat on the submersible, suggested that seeking classification could take years and would be 'anathema to rapid innovation'.
In 2019, the firm added that seeking classification for Titan would not 'ensure that operators adhere to proper operating procedures and decision-making processes – two areas that are much more important for mitigating risks at sea'.

Classification involves recruiting an independent organization to ensure vessels like ships and submersibles meet industry-wide technical standards. It is a crucial way of ensuring a vessel is fit to operate.
The Manned Underwater Vehicles committee of the Marine Technology Society said in a statement about the tragedy that the 'modern commercial submarine industry' is 'regulated in accordance with international safety standards through classification societies.'
They added: 'These organizations have rules and safety standards for the design and construction of systems ranging from submersible vehicles to super tankers and oil platforms.
'The main classification organizations for submersibles include the American Bureau of Shipping (ABS), Det Nortke Veritas (DNV) and Lloyds Registry (LR) among others.
'The submarine industry has a safety record of fifty years without incident.
'This is due to the engineering discipline and professional approach exercised by members of the industry, and the collective observation of (and adherence to) a variety of safety standards.'

I was watching traditional birthday celebrations in UK, Russia summits, getting cheated on my cell phone billing (they admit my autopay was activated, it worked last month, but I noticed they didn't process autopay this month, spending hours telling them to process the payment abd they refused! I went to one of their stores, the rep is looking at my bill, asking me, "What did you purchase this month?" I said, "I came here to get MY questions answered on why you are billing me like this and you ask me what is on your billing? Just answer my questions. I have not purchased anything for a very long time." He said, "Get out or I will call police" I was not yelling. I WAS NOT THREATENING. I just told him to do his job. At that point I cussed at him and said I am getting service elsewhere, and walked out. Here I told them I suffered debilitating ulcer pain the next day because they admitted I was on autopay, that they had correct payment info, and still REFUSED TO PROCESS MY PAYMENT. AND REFUSED TO TELL ME WHY THEY WERE CHARGING ME $40 MORE NEXT MONTH.
MY NEW SERVICE WILL BE ACTIVATED BY MONDAY.....
